Unnatural Sex, Husband-Wife and HC: मध्य प्रदेश हायकोर्टाने पती-पत्नीमधील शारीरिक संबंधाबाबत एक मोठी टिपण्णी केली आहे. भारतात 'वैवाहिक बलात्कार' हा गुन्हा म्हणून ओळखला जात नाही, असे नमूद करून मध्य प्रदेश उच्च न्यायालयाने सांगितले की, पत्नीच्या संमतीशिवाय एखाद्या पुरुषाने पत्नीसोबत ठेवलेले अनैसर्गिक लैंगिक संबंध हा बलात्कार ठरणार नाही. अशा परिस्थितीत या कृत्यासाठी पत्नीची संमती महत्वाची ठरत नाही. न्यायमूर्ती गुरपाल सिंग अहलुवालिया यांच्या खंडपीठाने सांगितले की, वैध विवाहादरम्यान पत्नी तिच्या पतीसोबत राहत असल्यास आणि ती पंधरा वर्षांपेक्षा कमी वयाची नसेल, तर पतीने स्वत:च्या पत्नीसोबत ठेवलेले कोणतेही लैंगिक संबंध बलात्कार ठरत नाहीत.

हायकोर्टाने म्हटले आहे की, कायद्याच्या या स्थितीला केवळ आयपीसीचे कलम 376B अपवाद आहे. यामध्ये विभक्त झालेल्या किंवा वेगळे राहत असलेल्यापत्नीसोबत लैंगिक कृत्य केल्यास तो बलात्कार होईल. मध्य प्रदेश उच्च न्यायालयाने मनीष साहू नावाच्या व्यक्तीविरुद्ध त्याच्या पत्नीने दाखल केलेला एफआयआर फेटाळताना ही टिप्पणी केली आहे. एफआयआरमध्ये महिलेने पतीवर आयपीसीच्या कलम 377 अंतर्गत अनैसर्गिक लैंगिक संबंधाचा आरोप केला होता. मात्र पतीने दावा केला की, हे दोघे पती-पत्नी असल्याने त्यांच्यामधील कोणतेही अनैसर्गिक लैंगिक संबंध हे आयपीसीच्या कलम 377 नुसार गुन्हा ठरत नाहीत.
