HC On Live-in and Divorce: लिव्ह इन रिलेशनशिपध्ये कायद्याने घटस्फोट मागता येणार नाही- हायकोर्ट
लिव्ह इन रिलेशनशिपमध्ये राहणाऱ्या जोडप्याचा घटस्फोटाचा अर्ज केरळ हायकोर्टाने फेटाळून लावला आहे. तसेच, भारतामध्ये लिव्ह इन रिलेशनशिपला कायदेशी मान्यता नाही. त्यामुळे केवळ करारावर एकत्र किंवा सोबत राहणाऱ्या जोडप्याला घटस्फोटासाठी अर्ज करता येणार नाही, अशी टीप्पणीही हायकोर्टाने केली.
लिव्ह इन रिलेशनशिपमध्ये राहणाऱ्या जोडप्याचा घटस्फोटाचा अर्ज केरळ हायकोर्टाने फेटाळून लावला आहे. तसेच, भारतामध्ये लिव्ह इन रिलेशनशिपला कायदेशी मान्यता नाही. त्यामुळे केवळ करारावर एकत्र किंवा सोबत राहणाऱ्या जोडप्याला घटस्फोटासाठी अर्ज करता येणार नाही, अशी टीप्पणीही हायकोर्टाने केली.
न्यायमूर्ती मोहम्मद मुस्ताक आणि सोफी थॉमस यांच्या खंडपीठाने म्हटले की, लिव्ह इन रिलेशनशिपला भारतात अद्याप तरी कायदेशीर मान्यता भेटली नाही. त्यामुळे कोणत्याही नातेसंबंधाला तेव्हाच कायदेशीर विभाक्त करता येते जो विवाह कायद्याला अनुसरुन झाला आहे. लिव्ह इन रिलेशनशिपमध्ये ना तलाक देता येऊ शकतो, ना घटस्फोट.
