HC on Watching Porn In Private: सार्वजनिक ठिकाणी एकट्याने पॉर्न पहाणं 'अश्लीलतेचा गुन्हा' नाही - उच्च न्यायालय
एखाद्याने फोनवर अश्लील फोटो किंवा व्हिडिओ शेअर किंवा सार्वजनिकरित्या प्रदर्शित न करता पाहणे IPC अंतर्गत अश्लीलतेचा गुन्हा नाही. असं मत कोर्टाने मांडलं आहे.
पोलिसांनी रस्त्याच्या कडेला त्याच्या मोबाईल फोनवर पोर्नोग्राफी पाहिल्याबद्दल एकाला अटक केली होती. पण केरळ उच्च न्यायालयाने त्या व्यक्तीविरुद्ध सुरू केलेली फौजदारी कारवाई रद्द केली आहे. कोर्टाच्या म्हणण्यानुसार, एखाद्याने फोनवर अश्लील फोटो किंवा व्हिडिओ शेअर किंवा सार्वजनिकरित्या प्रदर्शित न करता पाहणे IPC अंतर्गत अश्लीलतेचा गुन्हा नाही. अशा प्रकारच्या गोष्टी पाहणे ही व्यक्तीची खाजगी निवड आहे आणि न्यायालय त्याच्या गोपनीयतेमध्ये घुसखोरी करू शकत नाही.
